NOTICE IS HEREBY GIVEN that the City Council of the City of Desert Hot Springs will conduct a Public Hearing to consider a recommendation to 1) Find the City’s previous determination that the Project (the Housing Element for the 6th Cycle) is Exempt from the California Environmental Quality Act stands, because the amendments will not change the reasons for the Exemption; and 2) Adopt the amendments to the Housing Element for the 6th Cycle (2021-2029).

LOCATION: Citywide

APPLICANT/REPRESENTATIVE: City initiated.

PROPOSAL: State law requires cities to update their General Plan Housing Element. On January 12th, 2023, the City of Desert Hot Springs received approval from the Department of Housing and Community Development (HCD) for the adopted housing element, finding it in full compliance with State Housing Element Law (Article 10.6 of the Gov. Code). The adopted element was approved with the correction that vacant identified sites to accommodate the lower-income regional housing needs allocation (RHNA) were not identified in the two previous planning periods. These sites are therefore not required to be rezoned. The Housing Element is being amended to correct text regarding prior use of vacant sites, and to delete Program 1.2, as it is no longer required, consistent with the letter of approval received on January 12th, 2023.

ENVIRONMENTAL DETERMINATION: The Project is exempt from the CEQA Guidelines 14 Cal. Code. Regs Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the Project may have a significant effect on the environment as set forth in Section 21080.17 of the Public Resources Code.” The Project is further exempt pursuant to 14 Cal. Code. Regs Section 15162(a) of the CEQA Guidelines. Further, to the extent the Regional Housing Needs determinations are made, the Project is further exempt from the CEQA Guidelines 14 Cal. Code. Regs Section 15283, which provides, “CEQA does not apply to regional housing needs determinations made by the Department of Housing and Community Development, a council of governments, or a city or county pursuant to Section 65584 of the Government Code. Conditions have not changed, and the amendments proposed do not change the City’s determination. The amendments proposed are minor, and the Project remains exempt as described.”

INTERESTED PERSONS MAY be heard or written comments may be submitted prior to the Public Hearing(s). Written comments will be made a part of the public record. If you challenge this matter in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City of Desert Hot Springs, at or prior to, the public hearing.
